The Land Development Process

In order to optimise results from a potential land or property development project, it is vital to understand the various processes that are involved, to devise and apply the optimal strategy, to exploit opportunities and to avoid pitfalls.

Every site or development situation has different characteristics and each journey will be unique. Typically, projects where selling the property with the benefit of a planning permission is the preferred route would broadly follow the process below.

Site Assessment

  • Understand the property, landowner priorities, and planning opportunities.

  • Investigate technical and legal factors.

  • Consider options and agree forward strategy

  • Does the planning permission meet the Landowner’s aspirations?

  • Are there excessive costs, unsatisfactory planning restrictions, or reliance on 3rd parties

  • Is the value being maximized?

Agree Strategy for Obtaining

Optimal Planning Permission

  • If Landowner not self-funding the planning process, agree strategy for acquiring a ‘promotion partner’

  • Assemble information dossier for the opportunity.

  • Prepare to market the opportunity to generate competitive proposals from developers and promoters

Market the Opportunity

Select Planning Partner

  • Appraise and select potential planning partners – Promoters or Developers

  • Negotiate best possible terms and ensure Landowner is shielded from costs and risks

Planning Process

  • Work with planning partner to submit planning application in line with agreed strategy

  • Monitor planning partner to ensure acting diligently

  • Oversee project through planning process and ensure planning agreements are appropriate

Prepare site for market

  • Resolve Highways, 3rd Party land, Title or tenancy issues, ground investigations, utilities surveys

  • Prepare detailed information pack and agree marketing strategy

  • Create competitive tender process to achieve best possible offers

Sale and on-going monitoring

  • Select purchaser and ensure completion of sale

  • Ensure any post-completion Landowner requirements fulfilled and any deferred payments received

  • Monitor development for any changes resulting in uplift or overage payments
